Terms of Participation
 
The MVB MVP Program (the “Program”) starts on September 1st , 2012 at 9:00 AM Eastern Time (“ET”) and ends on December 1st, 2012 at 11:59 PM ET (“Program Period”).
 
PROMOTER: MVB Bank / West Virginia Radio Corporation
 
As a 2012 MVB-MVP award recipient participating in this Program, you agree to adhere to the following:
 
HOW TO PARTICIPATE: Be chosen by the MVB-MVP Sports Team for  a performance during the 2012 High School Football Season.
 
If selected as the AAA,AA or A MVB-MVP of the week you grant permission for your interview and stats to be posted on www.themvb-mvp.com and www.themvbmvp.com site and other websites designated by Promoters. You agree that Released Parties (as defined below) are not responsible for any unauthorized use of likeness by third parties.
 
PUBLIC VOTING: 2011 6 Days after posting (“Voting Period”). During the Voting Period, individuals can register their vote with the website. Limit one (1) vote per person and per email address per day during the Voting Period. Votes received from any person or email address in excess of the stated limitation will be void. You are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, as determined by Promoter in its sole discretion. Subject to verification of eligibility and compliance with these Official Rules, the participant school that receives the highest number of valid votes, as determined by Promoter, will have the potential Grand Award recipient. In the event of a tie, MVB-MVP spots team will select the winner, in its sole discretion.
 
NOTIFICATION: Promoter’s decisions are final and binding on all matters relating to this Program. Participant ay received the highest number of votes and their corresponding school will be notified by telephone, mail and/or email and will be required to complete an Affidavit of Eligibility, Liability and Publicity Release. Any result in disqualification and, at Promoter’s sole discretion, the award may be awarded to a runner-up.
 
GRAND AWARD (1): A $1,000.00 donation to participant school received the highest number of votes.  School will be responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with award acceptance and use not specified herein as being provided. All award details are at Promoter’s sole discretion.
GENERAL: Program is void where prohibited by law and subject to all applicable federal, state and local laws. By participating, you agree: (a) to abide by these Terms of Participation and decisions of Promoter, which shall be final and binding in all respects relating to this Program; (b) to indemnify, release, discharge and hold harmless Promoter,  and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from your participation in the Program or the acceptance, possession, use or misuse of the award; (c) to the use of your name, voice, quotes, comments, biographical information, essay, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Promoter and its designees, without compensation (unless prohibited by law) or additional consents from  you or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so; and (d) your participation in the Program will not violate any contracts between you and third parties, or the rights of any third parties. You agree not to issue any publicity or communicate with the members of the press through any means without the prior express consent of Promoter.

Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled essays votes; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program, the tabulation of votes, the processing of votes, the announcement of the award, or in any Program-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program.  Released Parties are not responsible for injury or damage to your computer related to or resulting from participating in this Program or downloading materials from or use of the website.  Persons who tamper with or abuse any aspect of the Program or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Terms of Participation, as solely determined by Promoter, will be disqualified and all associated votes will be void. Promoter may disqualify you as a participant in the Program if, in its sole discretion, it determines that you are attempting to undermine the legitimate operation of the Program by cheating, deception or other unfair voting practices, or intending to annoy, abuse, threaten or harass any other participant or Promoter’s representatives. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program. CAUTION: ANY ATTEMPT MADE BY YOU TO DAMAGE ANY WEBSITE OR DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM YOU TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Promoter reserves the right in its sole discretion to cancel or suspend any portion of the Program should causes corrupt the administration, security or voting of the Program and, in the event of cancellation, to select the essay receiving the highest number of votes from among all eligible, non-suspect votes received up to time of such impairment using the procedure outlined above. You are an independent contractor of the Released Parties and your participation does not create any association, partnership, joint venture or employee relationship with any of the Released Parties.
 
MVB-MVP Contest Voting Terms
 
Voting is open to legal residents of the fifty (50) United States and District of Columbia who are 13 years of age or older. Employees of MVB Bank and West Virginia Radio Corporation (“Promoters”), are not eligible to vote. Void where prohibited by law. The voting process for the MVP Contest (“Contest”) is subject to all applicable federal, state, and local laws and regulations.
